Oops.  Oh, well.  Better late than never.

I am curious, though, what possible "non-amicable" resolution of this
matter they envisioned with the Data Communications Bureau of the Chinese
Ministry of Posts and Telecommunications.

Unfortunately, history will never know.

Dear Sir or Madam:

     I represent Religious Technology Center ("RTC"), the owner
of the confidential Advanced Technology of the religion of
Scientology, and the holder of exclusive rights under the
copyrights applicable to the Advanced Technology materials. 

     I do not speak Chinese, so I am writing in English and hope
that you understand.

     We have been informed that someone has downloaded to your
FTP site two postings of copyrighted, unpublished materials. 
These postings were made without the authorization of our client,
which, of course, would not have given such authorization had it
been requested.  The first pages of these postings are included
at the bottom of this message.  These postings are located on the
"current directory is/incoming."  The first one is called
"SCAMIZDAT-10" and the other is "Fishman."  "SCAMIZDAT-10"
includes a number of affidavits but starting from line 1,700
there are many pages of confidential copyrighted materials.  The
other document entitled "Fishman," also includes a number of
affidavits but again starting at about 1,700 lines there are many
pages of copyrighted materials.  The copying of these materials
on this FTP site, violates my client's legal rights in that it is
the unauthorized making of electronic copies of the copyrighted
material and the unauthorized disclosure of trade secrets
materials.

     These actions constitute violations of the United States
Copyright laws entitling my client to damages and injunction.  I
understand that this is also a violation of the China Copyright
Act.  It is essential that you take action to remove the
material.

     We understand that the rules of most systems prohibit
subscribers from posting, downloading or distributing copyrighted
materials.  We are also informed that the usual practice of
systems operators in dealing with violations of their system
rules is to first warn subscribers when complaints of wrongdoing
are received, and then cancel the account if the subscriber
continues his or her wrongdoing.  

     We request an immediate confirmation that the materials have
been removed.  We would much prefer to resolve this matter with
you amicably if you are willing to do so.
